LEVEL UP YOUR LUNCH ON-PACK PROMOTION.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions. Please retain a copy for your information.

1. THE PROMOTER

KP Snacks Limited, Fifth Floor, The Urban Building, 3-9 Albert Street, Slough, SL1 2BE.

2. ELIGIBILITY

This prize promotion (the “Promotion”) is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over at the time of entry excluding employees of the Promoter and their immediate families, the Promoter’s agents, third parties or any other person professionally connected with the Promotion.

3. Purchase necessary in England, Wales and Scotland. No purchase necessary in Northern Ireland.

4. THE PROMOTIONAL PERIOD

The promotional period will begin at 00:01 on 1st March 2020 (the “Opening Date”) and will end at 23:59 on 31st May 2020 (the “Closing Date”). All entries received after the Closing Date will be automatically disqualified.

5. HOW TO ENTER: GREAT BRITAIN (ENGLAND, SCOTLAND, WALES)

a. Purchase a qualifying product. Qualifying products are as specified in Paragraph 6 of these Terms and Conditions.
b. Text LUNCH followed by a space and the last 4 digits of your product barcode to 81181.
c. Only entrants who win a prize will receive a return text message. There is no text message to confirm receipt of entry.
d. Prize winners will receive a notification text message with a link through to a registration page where they will be able to claim their prize by confirming their mobile phone number and providing their name and home address details for receipt of their prize.

5.1. Entrants must have a mobile phone and Internet access to enter this promotion. Entry is by text only. Entrants must have a mobile phone able to send and receive messages to/from 5-digit short codes. Messages charged at service provider’s standard network rate. Texts may not be included in any text inclusive packages. Users on virtual mobile networks may not be able to text the short code. Please check with your network provider. Text lines are open 24 hours a day until 23:59 on the Closing Date. Ask the bill payer before texting. If you text before the Opening Date or after the Closing Date, you will not be entered but you will be charged. Take care when entering the text code; the Promoter is not responsible for mistypes and you may be charged at a higher rate. If you are unable to send a text, please check with your network operator first. 5.2. Entrants will not receive a text confirmation of receipt of entry. To check if your text entry has been received, go to lunchnextlevel.com and input your mobile phone number. The Promoter does not accept responsibility for entries or claims that are delayed or not received due to transmission, network or software problems or any other reason beyond the Promoter’s control.

5.3. Only winning entries will receive a text confirmation. There is no charge to the entrant for receiving this message.

5.4. Only 1 entry per person per day. Only one mobile phone number will be accepted per person. Any entrant using multiple mobile phone numbers to access the promotion will be disqualified and any prize entitlement will be void.

5.5. No third party or bulk entries. Entries via third parties or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that any entrant or the entrant’s household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data, using identities other than their own, using any other automated means in order to increase that entrant's entries, or otherwise acting dishonestly, fraudulently or otherwise in violation of these terms, such entrant will be disqualified, and any prize entitlement will be void.

5.6. Proof of purchase will not be accepted as proof of entry. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed or not received for whatsoever reason.

5.7. Please retain packaging and receipt in the event of a prize win.

5.8. This Promotion features across four of the Promoter’s brands (Hula Hoops, McCoy’s, Skips and Nik Naks) with one shared prize pool.

Only one (1) entry is permitted per person per week. Only one mobile phone number will be accepted per person. 7.3 Only winning entries will receive a text confirmation. There is no charge to the entrant for receiving this message.

7.4 Prizes won via the NI free-entry route will only be dispatched to addresses in NI.

8. WINNER SELECTION

8.1. There are 4,175 prizes guaranteed to be won during the Promotion. All prizes are allocated via an open winning moments algorithm. If you enter during a winning moment, you win a prize pre-allocated to that moment by an independent third party.

8.2. Prizes are pre-allocated via an open winning moments algorithm created by an independent third party. If your time of entry matches a guaranteed winning moment, then you will be awarded the prize randomly pre-allocated to that moment by the independent third party. If in the event that two entries are received at the same time, the entry processed by the server first will be the winning entry. In the event that no one enters at the winning moment, that prize will remain available until the next entry. All prizes will be won.

8.3. An entrant can win a maximum of two prizes throughout the promotional period.

9. THE PRIZES

9.1 There are 5 prizes of lunch at a Skyscraper to be won. Each winner can choose one prize from any of the following four destinations:

i. New York: Prize includes return economy flights for 2 people to New York, return transfers from the airport to the hotel, 5 nights’ accommodation in a 5-star hotel, breakfast for 2 people in the hotel restaurant each morning, x1 lunch for 2 people at One Dine on the 101st floor of the One World Observatory, ESTA fees for 2 people (if required), travel insurance and £1,000 spending money.

ii. Dubai: Prize includes return economy flights for 2 people to Dubai, return transfers from the airport to the hotel, 5 nights’ accommodation in a 5-star hotel, breakfast for 2 people in the hotel restaurant each morning, x1 lunch for 2 people at AT.MOSPHERE on the 122nd Floor of the Burj Khalifa, travel insurance and £1,000 spending money.

iii. Tokyo: Prize includes return flights for 2 people to Tokyo, return transfers from the airport to the hotel, 5 nights’ accommodation in a 5-star hotel, breakfast for 2 people in the hotel restaurant each morning, x1 lunch for 2 people at 634 Musashi sky restaurant, travel insurance and £1,000 spending money.

iv. Bangkok: Return flights for 2 people to Bangkok, return transfers from the airport to the hotel, 5 nights’ accommodation in a 5-star hotel, breakfast for 2 people in the hotel restaurant each morning, x1 lunch for 2 people at Sirocco on the 63rd Floor of the Lebua Hotel, travel insurance and £1,000 spending money.

9.2 The following prizes are also available to be won: i. 170 x Restaurant Choice vouchers to the value of £100; ii. 1,000 x Restaurant Choice vouchers to the value of £50; iii. 1,000 x Restaurant Choice vouchers to the value of £25; iv. 2,000 x Restaurant Choice vouchers to the value of £10

9.3 All travel prizes must be booked by the prize winner within 12 months from the date of initial correspondence.

9.4 Flights are subject to availability at the discretion of the booking agent and excludes flying on bank holidays and during school holidays in both the UK and destination chosen, specifically Christmas holidays (19th December 2020 – 6th Jan 2021, 19th December 2021 – 3rd Jan 2022), summer holidays (19th July – 7th September 2020, 18th July – 3rd September 2021), Valentine’s day/weekend (12th-14th February 2021) spring and autumn half terms (12th – 24th October 2020, 15th – 19th Feb 2021, 15th – 29th October 2021) and Easter holidays (1st – 16th April 2021).

9.5 Prize includes return economy class flights, all flight taxes and surcharges as well as one piece of checked baggage per person. Prize does not include domestic travel, additional expenses, additional meals, tips or personal expenses. A Saturday night stay is a requirement. Subject to availability, departure airport used will be the winner’s nearest international airport that operates flights to chosen destination. This may not be your closest airport. If you do not hold a UK passport you may need a visa, and this should be arranged by you at your own cost with the appropriate embassy (the cost of the visa will not be refunded to you). Transfers will be private and not shared with other passengers. You will be staying in a 5* hotel, sharing a double room with en-suite bathroom on a bed and breakfast basis. Lunch is based on a 3-course meal from the lunch menu for 2 adults, including 1 bottle of wine up to the value of £200 and 1 bottle of mineral water to be shared between 2 people and 1 hot beverage per person. In the USA, alcohol will only be served to persons who are 21 years or older. ID may be required to order/purchase. Travel insurance is subject to normal terms of acceptance. Pre-existing medical conditions may not be covered. No age restrictions apply.

9.4 UK Passport holders travelling to the United States of America are required to have a valid ESTA (Electronic System for Travel Authorization) from the US Embassy. You can apply for this a minimum of 72 hours prior to travel although we recommend you apply as soon as your travel is confirmed. Please note that anyone without an ESTA will be deported from the US upon arrival without exception. It is the winner’s responsibility to comply with the ESTA visa requirements of the US. Approval is at the discretion of the US Embassy and the Promoter cannot be held responsible for this being rejected.

9.5 Each winner of a travel prize assumes all risks inherent to their trip and the Promoter will not accept liability for damages, injury or death other than if caused by the negligence of the Promoter. The Promoter accepts no liability for any aspect of the experience relating to flights, transfers or accommodation. Each winner and their guests may be required to sign disclaimers absolving the Promoter from liability to this extent during their travel and participation in this Promotion.

9.6 Each winner of a travel prize is responsible for ensuring that the travel insurance included as part of the prize is sufficient to meet the requirements and expectations of the travelling individuals, including the provision of adequate cover for any pre-existing medical conditions. Any additional travel insurance protection required must be purchased by the winner at the winner’s own cost.

9.7 The value on the Restaurant Choice Gift Card can be used as full or part payment at any participating restaurants in England, Scotland, Northern Ireland or Wales. For a list of participating restaurants go to https://www.restaurantchoice.co.uk/restaurants. Gift cards valid until 31st December 2020. Please note that the date of purchase can be different from the date you have received the gift card. Please inform the restaurant beforehand that you intend to settle the bill using your gift card. Any overspend can be settled using cash or a credit or debit card to make up the remaining amount. If the Card value is not spent in full, any remaining funds will stay on the Card as long as the Card is valid or until the remaining funds are used in full. The Restaurant is responsible for the correct processing of the Card. The Restaurant is responsible for providing the goods or services you purchase. For problems relating to your purchases from a Restaurant, you must deal directly with the Restaurant involved. Any refunds on Card transactions are subject to the policy of the specific Restaurant. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds. 9.8 Prizes are not transferable and there is no cash alternative.

9.9 The Promoter reserves the right to replace a prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.

9.10 Skyscraper lunch winners will be contacted by email within 5 days of prize claim.

9.11 Restaurant Choice Gift Card prizes will be dispatched to winner’s postal address within 28 days of prize claim.

10. WINNER NOTIFICATION

10.1 The winners will be notified via text message. It is the responsibility of the entrant to ensure that they click through to the prize claim page and provide their contact details

10.2 It is the winner’s responsibility to provide their correct, up-to-date details when confirming acceptance of the prize in order for their prize claim to be processed. The Promoter cannot be held responsible for a winner failing to supply accurate or complete information which affects prize acceptance or delivery of their prize.

10.3 Winners have 28 days to claim their prize. Winners may be required to provide proof of purchase before prize dispatch.

10.4 The Promoter does not accept any responsibility in the event a winner is not able to take their prize.

10.5 Winners may be asked to take part in reasonable publicity without payment. Such publicity may include, without limitation, using a winner’s name and, if relevant, their image and any statements made by them concerning the Promotion and the prizes won as part of the Promotion. The Promoter will not use an entrant’s personal data for publicity purposes without the entrant’s consent. This does not prevent the Promoter from disclosing the winner’s surname and county of residence in accordance with paragraph 12.10 of these Terms and Conditions.

10.6 Any unclaimed prizes will be put into a random prize draw of all entrants at the end of the promotional period, which would take place on 29th June 2020, with winners notified on 30th June 2020 by phone call or text.

11. LIMITATION OF LIABILITY

11.1 Insofar as is permitted by law, the Promoter and its agents will not in any circumstances be responsible or liable to compensate entrants for any losses that may be incurred as a result of entering the Promotion and the Promoter does not accept any liability for any loss, damage, personal injury or death occurring as a result of a winner’s acceptance of a prize except where such damage or loss is caused by the negligence of the Promoter or its agents.

12. DATA PROTECTION

12.1 Any personal information that entrants share with the Promoter will be kept secure and only used in line with these Terms and Conditions and the Promoter’s privacy policy. By entering the promotion, entrants agree that their information may be used by the Promoter to administer the promotion. Entrants' personal data will be used and will be held in accordance with the Promoter's Privacy Policy, which is available here: https://www.kpsnacks.com/transparency-notice/

13. GENERAL

13.1 Promoter’s decision is final and binding in relation to all matters relating to the Promotion. No correspondence will be entered into.

13.2 By entering this Promotion and entrant agrees to be bound by these Terms and Conditions.

13.3 Instructions provided at the point of entry form part of the Terms and Conditions of this Promotion. In the event of a conflict, these Terms and Conditions take precedence.

13.4 The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these Terms and Conditions or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.

13.5 The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment.

13.6 The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.

13.7 The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notifications or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries, including any such failure which is within the control of The Promoter or its agencies.

13.8 It is the responsibility of the entrant to provide their correct, up-to-date details when confirming acceptance of the prize in order for their prize claim to be processed. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

13.10 The surname and county of major prize winners (5x Skyscraper lunch winners, and 170x £100 Restaurant Choice winners) will be made available to anyone who requests them by emailing KPFlavour@winnerslist.co.uk within 3 months of the closing date. Winners may request their surname and county are not published in the event they win by emailing KPFlavourOptOut@winnerslist.co.uk before the closing date.

13.11 The Promoter’s decision is final and binding in all matters relating to the Promotion and no correspondence will be entered into.

13.12 If any clause or provision of these Terms and Conditions is declared by a court to be illegal, invalid or unenforceable, this declaration shall not affect the validity and enforceability of any other clause or provision within

13.13 These Terms and Conditions shall be governed by the laws of England and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.
